Reasonable doubts with ATI Nvidia

First of all, hello everyone, my dilemma: I've been thinking for a while that it's time to upgrade my equipment, but between one thing and another, I've been putting it off :wall: I have a micro that I've almost decided on (970 AMD), and I'm having trouble deciding between a GTX 560 Ti or an ATI 5870 1G, both second-hand and more or less at the same price.
According to this, I understand that the Nvidia is only better in consumption (lower) and in opengl 4.1 versus 3.2 and in the cooling system. Another option I had in mind was the 7770 (new), but according to what I saw here, my GTX 280 would eat it for breakfast. My budget would be around 140 at most.
Do you think the 5870 is the best option?

Well, based on comparisons, I see the 5870 as the clear winner, if it has to be one of those three.

I think they perform similarly and I would go for the Nvidia because it's more modern and, being second-hand, less used. Or in other words, the 5870 is a good graphics card but if it's already two years old or more... I'd rather buy a more modern graphics card with less wear and tear. Both perform equally depending on the game.
It all depends on whether you know the person selling it to you. Anyway, I would avoid buying a graphics card without an invoice. People lie a lot about Overclocking, a micro with overclock can last the entire life of the PC, retire the PC and still perform, but a graphics card with Overclock fails sooner. You'll see few people who have their micro burned out, but many people with burned out graphics cards... it's advice.
The 7770 is not an option given the graphics card you have. I would actually try to extend the life of your graphics card unless you are very demanding and it falls short, but I had an Ati 4770 in my rig half a year ago that performed like a 4580 or an Nvidia 8800… times have changed, and at 1280*1024 I played everything on high settings or some on medium. I played without filters though. But it was BF3 that made me buy the 5850 Xtreme for 90€ on hard2mano and with an invoice. I got a good deal at a good price, I sold the 4770 for 30€ I think, a good price, and for 60€ I had a graphics card to run BF3 :troll:

that is my problem, the damned BF3 :troll: in the comparisons I have looked at, the 5870 comes out better than the 560 ti except in BF3 and in Batman, I have more and more doubts :wall: the truth is that I have always been more drawn to Nvidia than ATI

It depends on the resolution you play at. Note that the analysis is with Ultra details. At high details, without filters... any of the graphics cards will be much more than adequate.
